These terms and conditions (the "Terms and Conditions") are the terms and conditions upon which Rebel Books LLP ("we/us/ Rebel Books") make www.rebelbookspublishing.co.uk ("the Website") available to you and any of our services which are accessible on or via the Website. These Terms and Conditions govern you use of the Website and purchase of any goods or available services. The headings are for guidance only and not to be used in the interpretation of any clause.
1. The Contract
1.1 Any contract for purchases made through the Website will be with Rebel Books LLP, 147 Newbrook Road, Over Hulton, Bolton, BL5 1EY Partnership Number OC345244 ("Rebel Books")
1.2 Rebel Books must receive payment of the whole of the price for the goods that you order before your order can be accepted and the contract formed. Once payment has been received Rebel Books will send email confirmation that your order has been received and accepted to the email address you provide when transferring payment or completing the on-line order form. The email will include your name, the order number and the total price together with the anticipated delivery date and your cancellation rights. Rebel Book’s acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract. Rebel Books will also send notification by email to the address provided to confirm despatch of the goods.
1.3 We cannot accept orders from customers under the age of eighteen (18) years.
2. Prices & Payment
2,1 All prices are shown, invoiced and payable in UK sterling.
2.2 Except as otherwise stated on the Website all prices are exclusive of packaging and delivery which will be determined by the Rebel Books based on items and quantities ordered, which you shall be additionally liable to pay to Rebel Books. The price is also exclusive of any applicable value added tax, excise, sales or taxes or levies of a similar nature which are imposed or charged by any competent fiscal authority in respect of the Goods, which you shall be additionally liable to pay to Rebel Books
2.3 Pre-payment by credit/debit card is the quickest and simplest way via Paypal using rebelbooks@hotmail.com. We also accept payment by BACS (please contact us for our bank details) and by cheque drawn on a UK bank in £ sterling made payable to REBEL BOOKS LLP (please allow 7 working days for cheques to clear). If you wish to pay by another method please contact us. If you wish to pay by cheque you should complete your purchase via the on-line order form rather than via the shopping cart. 2.4 If for any reason payment for the Goods is returned unpaid then Rebel Books will not confirm acceptance of the order and no contract will be formed.
2.5 Time for payment of the price shall be of the essence of the Agreement.
2.6 All orders are subject to availability.
3. Withdrawal from the Contract
3.1 Rebel Books are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on the Website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email. This will be to inform you of the correct price of the goods and to ask you is you wish to continue with the order at the amended price, or to cancel the order altogether in which case any monies paid to Rebel Books in connection with the order concerned will be refunded in full as soon as possible and in any event within 30 days of receipt of your notification of cancellation of the order.
3.2 If you are an individual and are not buying goods on behalf of a business, there are certain circumstances in which you may withdraw from the contract and these are set out here, This right to withdraw does not apply to business buyers.
You may withdraw your order for goods at any time up to the end of the seventh working day after you have received the goods. You do not have to give Rebel Books any reason for withdrawing your order nor will you have to pay any penalty
- If you do withdraw your order after receipt of the goods or after Rebel Books have already processed your order and the goods have been dispatched to you, you should not unpack the goods and they must be returned to Rebel Books in their original condition within 30 days at your own cost and risk.
- You must take reasonable care of the goods whilst they are in your possession
- To withdraw your order you must notify Rebel Books in writing at the address set out above, once you have notified Rebel Books that you are withdrawing your order, any sum paid by you to Rebel Books in respect of the order concerned will be refunded to you as soon as possible and in any event within 30 days of receipt of notification of withdrawal of your order providing the items returned are in their original condition.
4. Availability
4.1 Rebel Books aims to despatch all orders within 30 days of receipt and will send you notification to the email address provided that goods have been despatched. If Rebel Books is unable to deliver the goods ordered by you within this time, we will notify you at the email address you have provided us with and any sum paid to Rebel Books in connection with the order concerned will be refunded to you. Any refund will be made as soon as possible and in any event within 30 days of notifying you that the order cannot be fulfilled. Rebel Books will not be obliged to offer any additional compensation for disappointment suffered and any liability is strictly limited to the extent of the amount received by Rebel Books for the order concerned.
4.2 We aim to keep our availability information regularly updated but it is possible that in some instances a title may become unavailable between updates.
5. Delivery
5.1 Rebel Books will post, or arrange delivery on your behalf, for goods ordered by you to the person and address you have confirmed to us for delivery.
5.2 For goods delivered outside the EU, the consignee (i.e. the person to whom the consignment is sent) will be the declarant and imported into the country for which the consignment is destined. The consignee will be responsible for both customs clearance and payment of customs duties and local taxes where required. If you are ordering goods for delivery outside the EU, please note that your consignment may be subject to import duties and taxes, which are levied once the goods reach the country of destination. It is accepted by you that Rebel Books has no control over additional charges in relation to customs clearance. Rebel Books therefore recommends that you check with your local customs officials or post offices for more information regarding importation taxes/duties that may be applicable to your online order.
5.3 Delivery will be made as soon as possible after receipt of your order and in any event within 30 days of despatch. Please note that all delivery times quoted on the Website are estimates only.
5.4 Unless otherwise stated on the item description you will also be responsible for postage & packaging as they appear at the Bookstore. At present this is on a per item basis and includes a 50p packaging fee.

These prices are subject to change depending on the rates provided by Royal Mail but are up to date as at 6th April 2010.
5.5 You will become the owner of the goods you have ordered when the goods are despatched to you.
6. Returns/ Non-Delivery
6.1 If the goods Rebel Books delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Rebel Books shall have no liability to you unless you notify them of the problem in writing within 7 working days of the delivery of goods in question. In any event the maximum liability of Rebel Books is strictly limited to the amount received from you in connection with the order concerned.
6.2 You should return the item to us together with the details of why the item is being returned and we will arrange to send a replacement item upon receipt of the returned item. Rebel Books will cover the cost of returning any incorrect, faulty or damaged items. If it is impossible to replace your item we will issue a refund of any monies received by us in respect of the incorrect, faulty or damaged item as soon as possible and in any event within 30 days of receiving the return.
6.3 If an item is incorrectly supplied and we have made a mistake in fulfilling your order, a full refund (including postage costs) will be given subject to the following conditions:-
- The book must be returned within 28 days of receipt for the United Kingdom and Europe and 60 days for the Rest of the World in pristine and resaleable condition.
- It must be accompanied by a copy of the delivery note or your electronic receipt.
- Items should be returned by the most economical method. They remain your property until we have received them.
- All returns are accepted at the discretion of Rebel Books, please allow 14 days (in addition to delivery time) for the return to be processed.
6.4 If you do not receive goods ordered by you within 30 days of the date on which they were despatched to you, Rebel Books shall have no liability to you unless you notify Rebel Books in writing of the problem within 40 days of the date on which the goods were despatched to you.
6.5 If you notify Rebel Books of a problem under this condition Rebel Book’s only obligation will be, at its option, to make good any shortage or non-delivery; to replace any goods that are damaged or defective; or to refund to you the amount paid by your for the goods in question. In any event Rebel Books’ liability will be limited to the amount received from you for the order concerned and will not be liable for any indirect or consequential loss or damage arising out of any problem notified to Rebel Books under this condition and Rebel Books shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question. If you do not notify Rebel Books within the above time periods then there will be no obligation on us to replace or refund items.
6.6 Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit Rebel Books’ liability to you for any death or personal injury resulting from its negligence.
7. Third Party Rights
A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.
8. Force Majeure
Rebel Books shall have no liability to you for any failure to delivery goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
9. Invalidity
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected thereby.
10. Complaints
Rebel Books operates a complaints handling procedure which is used to try to resolve disputes when they first arise. If you have a complaint please contact Rebel Books at admin@rebelbookspublishing.co.uk
11. Refunds
In the case of a refund being issued the method of refund will be at the discretion of Rebel Books and will be sent either by cheque or via Paypal to your account. If neither of these options are available then Rebel Books will issue you with a credit note to be used against future purchases.
12. Notices & Communications
12.1 All notices required under these Terms and Conditions must be given in writing which includes any communications effected by email, facsimile transaction, via first class post or any comparable means but must be done by durable media.
12.2 When you visit the Website or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
13. Disclaimer
13.1 The nature of Internet communications means that your communications may be susceptible to data corruption, interception and delays. Rebel Books shall not be responsible for any detrimental reliance you place on the Website or its contents.
13.2 Rebel Books is providing this site and its contents (including any downloadable data or software) on an 'as is' basis and makes no representations or warranties of any kind with respect to this site or its contents and disclaims all such representations and warranties, whether express or implied, to the fullest extent permitted by applicable law. In addition, Rebel Books makes no representations or warranties about the accuracy, completeness or suitability for any particular purpose of the information and related graphics published in this site or that any software or the server that makes it available are free of viruses or other harmful components.
13.3 The information contained in this site may contain technical inaccuracies or typographical errors. All liability of Rebel Bookss’ howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by applicable law.
13.4 Neither Rebel Books nor any of its Partners, employees or other representatives will be liable for damages arising out of or in connection with the use of the Website in any way. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
13.5 The security of information and payments transmitted via the Internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of email or other internet link shall be borne solely and exclusively by such user and in no event shall any such losses in whole or part by borne by Rebel Books
14. General
14.1 Illustrations, photographs or descriptions whether in catalogues, brochures, price lists or other documents issued by the Seller or displayed on the Seller’s website are intended as a guide only and shall not be binding on the Seller.
14.2 All contracts under these Terms shall be governed by and construed in accordance with the Laws of England and all disputes shall be submitted to the non exclusive jurisdiction of the English Courts.
14.3 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Website and/or purchase goods from time to time. We will post any changes on the Website and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Website. Changes will be effective immediately after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.
14.4 Additionally, we reserve the right to suspend, restrict or terminate access to the Website for any reason at any time.
14.5 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Interflora Site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement
These terms and conditions, together with the current Website prices, delivery details and contact details, set out the whole of our agreement relating to the supply of the goods to you by Rebel Books. These terms and conditions cannot be varies except in writing signed by a partner of Rebel Books. In particular nothing said by any sales person on behalf of Rebel Books should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Rebel Books. Rebel Books shall have no liability for any such representation being untrue or misleading. By submitting your order to Rebel Books you are consenting to be bound by these Terms and Conditions.

17. Defamation claims
It is not always possible for us to be aware of the contents of each product listed for sale, or each comment or review that is displayed. Accordingly, Rebel Books operates on a "notice and takedown" basis. If you believe that any content on, or advertised for sale on, the website contains a defamatory statement, please notify us immediately at admin@rebelbookspublishing.co.uk. Once this procedure has been followed, Rebel Books will make all reasonable endeavours to remove the defamatory content complained about within a reasonable time.
